Why is my landlord trying to end my lease?

We provide services for new tenants taking business leases in the form of an acquisition report where I look into the deal you have and summarise the positives and areas for concern. This is an effort to reduce common sources of lease disputes. The most common sources of these disputes are:

1️⃣ Lack of payment of rent – This is the most common reason for a termination. Leases often prescribe a certain amount of days’ grace, usually 14 or 21 days, that the tenant has before the landlord begins the process, which can be peaceful entry (changing locks) or formal proceedings to gain access. Leases tend to specify that rent is payable whether formally demanded or not.

2️⃣ Damage to the property – Damage to a property is relative and this often comes in the form of unlicensed works and alterations which causes the landlord to take action. A landlord can often allow good alterations subject to documentation, but bad quality or fire safety issues can result in their hands being forced after an inspection.

So what tools does a tenant have to fight back? A good solicitor is important here, but it is also important to ensure:

1️⃣ Rent should always be paid whether you receive invoices demanding it or not. Part payments or payment plans can prevent legal proceedings in some cases.

2️⃣ Alterations to properties can be documented by a license for alteration which can be agreed retrospectively. Landlords don’t have to agree to this after you have done the works without prior permission, but it’s definitely worth suggesting.

There are lots more situations that cause your landlord to begin disputes that can ultimately lead to proceedings to take back your leased premises. If you are already in a lease dispute, contact us today and we can provide 360 degree support with our contacts with solicitors and external surveyors. However, prevention is the most effective cure. It is better to have a water tight lease agreement and genuine understanding of what terms and obligations you are signing up to before the lease is completed.
